EMPLOYEE BENEFITS LIABILITY

Protects against negligent acts, errors or omissions committed by you or any person for whose acts you are legally responsible for while engaging in the management of employee benefit plans.

COMMERCIAL GENERAL LIABILITY

CGL is commonly used to insure a wide range of liability loss exposures faced by most organizations. Covers damages for which you are legally liable and defends the insured against claims or suits alleging bodily injury or property damage and some intentional torts. Coverage for automobile, employment practices, professional, workers compensation and pollution are some of the exclusions.

UMBRELLA/EXCESS LIABILITY

Umbrella policies provide increased limits of liability coverage for scheduled underlying policies. It can be used 1) to provide additional limits of protection over the coverage listed in your underlying schedule, 2) to act as primary coverage if your underlying limits are exhausted, and 3) to provide coverage for some risks, subject to a self-insured retention, when your primary coverage does not. Excess policies provide increased limits for only those hazards covered by the underlying scheduled policies.

FIDUCIARY LIABILITY

FL addresses the decision-making exposure of how benefit funds are invested. True FL policies are normally written as a separate policy. Whereas Employee Benefits Liability protection is often added to the CGL by endorsement.

EMPLOYMENT RELATED PRACTICES LIABILITY

EPL provides protection against employment related lawsuits such as wrongful termination, sexual and non-sexual harassment, discrimination, discrimination under the Americans with Disabilities Act, failure to promote, demotion, wrongful discipline, negligent evaluation, negligent hiring as well as other violations of an employment related nature. Limited punitive damage coverage may be available.

DIRECTORS & OFFICERS LIABILITY

Covers actual or alleged acts, errors or omissions, misstatement or misleading statement, or breach of duty by past or present directors or officers while acting in their individual or collective capacities such as in securities-related suits. Coverage can be provided for non-profit and for-profit organizations.

PROFESSIONAL LIABILITY

Covers damage losses for which you are legally liable when such damages result from the rendering or failing to render professional services. This is common exclusion under the CGL policy when your organization performs services of a professional manner. There are several specific types of professional liability policies.

POLLUTION LIABILITY

Protects against losses arising from pollution conditions emanating from scheduled locations causing third-party property damage, bodily injury or cleanup costs. Legal defense costs are usually included within the limit of liability. Can also provide on-site cleanup of pollution conditions on, within or under covered locations as well as liability for cleanup at non-owned disposal sites.
